Overview

Under the California Municipal Separate Storm Sewer System (MS4) Permit, Priority Development Projects (PDPs) are required to implement post-construction Best Management Practices (BMPs) to minimize stormwater pollution. These structural BMPs such as bioretention basins, permeable pavements, and detention systems help control runoff, improve water quality, and protect local waterways.

To remain effective, these structural BMPs must be properly maintained. Without routine maintenance, structural BMPs can fail, leading to increased stormwater pollution, regulatory non-compliance, and potential penalties. The City is required to verify annual maintenance via two methods:

1. On-site Inspection

City Inspectors will inspect the BMPs on your property and provide an inspection report of the results. If maintenance if needed, documentation of maintenance must be provided.

2. Self-Maintenance Verification from Property Owners

Property owners/managers submit annual Maintenance Verifications (MVs) to confirm that BMPs are functioning as designed. Documentation of inspection and/or maintenance must be submitted to the City when requested. If property owners do not provide proof of inspection and/or maintenance, City inspectors will be required to perform an on-site inspection of the BMPs.

How Property Owners Can Comply

Property owners with BMPs must:

Regularly inspect and maintain their BMPs.

Submit annual Maintenance Verifications through the City's online platform (Portal).

Follow local guidance on proper BMP maintenance to avoid compliance issues.

The City has recently launch an online Portal to ease the process of Maintenance Verification submittals. *This Portal is replacing the 5502 forms that were sent via standard mail or email in the past.*
