Property owners or authorized representatives may complete a Trespass Authorization Form to allow law enforcement to take enforcement action against unauthorized individuals on the property.

Properties eligible to file a Trespass Authorization Form

Properties not eligible to file a Trespass Authorization Form

The purpose of the Trespass Authorization Form is to support enforcement during after-hours periods when the property owner or manager is not present. As such, the following property types are not eligible:

Retail Stores (for enforcement during regular business hours, including 24-hour operations). When retail stores are open to the general public, all members of the public are considered to be lawfully present.
Homeowners' Associations (HOAs). HOAs cannot file a trespass authorization request because any express or implied invitation to enter the premises eliminates the criminal intent required for trespassing enforcement in these circumstances.
Apartment Complexes. Officers on routine patrol are not in a position to determine whether individuals on the property are residents or authorized guests.
Condominium communities.
Occupied single family homes. For trespassing concerns at occupied residences, please call the non-emergency number at (619) 691-5151.
Businesses experiencing issues with individuals on the property. These situations may require alternative remedies, such as a restraining order.

Submission Instructions

If your business is eligible, please complete the Trespass Authorization Form and review all pages before submitting.

In accordance with SB 602, the form must be notarized.

Once completed and notarized, email it to the Community Relations team at Community_Relations@chulavistaca.gov.
